The Crypto Store allows Users to purchase pre-loaded Gift Cards, via Crypto Currency. At the User’s election, each Gift Card will allow the User to purchase goods and services on the selected Network. To purchase a Gift Card, select the Network of your choice and enter your email address. The purpose of the email address is so we know where to send your Gift Card. Once goods and services are purchased with the Gift Card, they will be added to your Account as if you purchased them via any traditional method.  

Payment Processing. We use Coinbase to manage and process all Crypto Currency payments. When you elect to purchase a Gift Card, you will automatically be routed to Coinbase to make the associate payment. You can make the payment, according to the instructions provided by Coinbase, by i) sending the correct amount of Crypto Currency to a QR Code or digital wallet address that is generated for your specific order or ii) by signing into your individual Coinbase account.  Once we detect that the payment has been submitted to the applicable Crypto Currency blockchain, we will send you an email confirming the same. Once the applicable blockchain network reflects the transaction in the number of consecutive blocks as required by Coinbase or as otherwise chosen by us in our sole discretion, we will send you a separate email, containing your pre-loaded Gift Card. Payment processing times will vary depending on the selected Crypto Currency, your location, and Coinbase’s operating status.  

PLEASE EXERCISE EXTREME CARE WHEN MAKING PAYMENTS VIA COINBASE. CRYPTO CURRENCY TRANSACTIONS ARE FINAL, CANNOT BE REVERSED, AND COMPANY IS NOT RESPONSIBLE FOR ANY ERRORS IN THE PAYMENT PROCESS.  

When you purchase a Gift Card with Crypto Currency, the equivalent amount of U.S. Dollars will be added to your Gift Card. Such equivalent amount will be determined by Coinbase, in its sole discretion, according to the current exchange rate between U.S. Dollars and the applicable Crypto Currency. Such exchange rate will be pinned at the time the underlying transaction is first detected on the blockchain. If the exchange rate expires prior to your submission of the applicable Crypto Currency payment, you may be required to resubmit payment to reflect the modified amount.   

ALL CRYPTO CURRENCY PURCHASE ARE FINAL. YOU ACKNOWLEDGE AND AGREE THAT CRYPTO CURRENCY PRICES ARE INHERENTLY VOLATILE, SUCH THAT THE PRICE OF A CRYPTO CURRENCY, RELATIVE TO U.S. DOLLARS, IS SUBJECT TO UNPREDICTABLE INCREASE OR DECREASES AT ANY TIME SUBSEQUENT TO YOUR PURCHASE OF A GIFT CARD, SUCH THAT THE RELATIVE VALUE OF THE CRYPTO CURRENCY YOU SPENT ON THE GIFT CARD MAY EXCEED (OR FALL BELOW) ITS U.S. DOLLAR EQUIVALENT.  IN THE EVENT THE RELATIVE VALUE OF THE CRYPTO CURRENCY YOU SPENT ON THE GIFT CARD SUBSEQUENTLY EXCEEDS THE U.S. DOLLAR VALUE OF THE GIFT CARD, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE NOT ENTITLED TO ANY REIMBURSEMENT.  

Coinbase Terms and Conditions. If Coinbase rejects your payment for any reason, including insufficient funds, Company reserves the right to contact you directly to seek payment. By using Coinbase, you are subject to the Coinbase Terms of Service, as updated from time to time in Coinbase’s sole discretion. You acknowledge and agree that Company has no control over the Coinbase Terms of Service. If Company receives notice that your activity violates the Coinbase Terms of Service or any other agreement between you and Coinbase, Company may, in our sole discretion, take action against your Account to bring you into compliance with such agreements. Such actions may include canceling a transaction or Gift Card or suspending your Account privileges. You agree to provide current, complete, and accurate purchase information for all transactions conducted via Coinbase. Coinbase may also process your personal information for its own purposes. Moonsworth has no control over how Coinbase processes your personal information and is not responsible for the same. Coinbase Fees. You acknowledge and agree that Coinbase may, at any point in its sole discretion, require Users to pay fees related to Crypto Currency transactions including, without limitation, taxes and gas fees. Company has no control over these fees. 

Goods and services on each Network are priced in U.S. Dollars. If the balance on your Gift Card is lower than the total price of the applicable goods/services, then you may pay the remaining balance via any other accepted payment method. Refunds for goods and services purchased with Gift Cards are subject to the terms and conditions set forth in the Terms of Service. No fees apply to Gift Card usage.  

Gift Card Limitations. To the maximum extent permitted by applicable law, all Gift Card purchases are final and may not be returned to Company in exchange for a refund. Gift Cards may not be converted back to cash or any other currency and may only be used to purchase goods and services on the Network. Gift Cards may not be used to purchase other Gift Cards and cannot be used to purchase goods or services outside of the Networks. Gift Cards may not be redeemed for cash. YOU MAY ONLY PURCHASE GIFT CARDS FROM THE CRYPTO STORE AND MAY NOT PURCHASE A GIFT CARD FROM ANY UNAUTHORIZED THIRD-PARTY. COMPANY MAKES NO REPRESENTATIONS, GUARANTEES, OR WARRANTIES WITH RESPECT TO ANY GIFT CARD PURCHASED FROM AN UNAUTHORIZED THIRD-PARTY AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE COMPANY FROM AND COMPANY HEREBY DISCLAIMS ANY LIABILITY OR RESPONSIBILITY RELATED THERETO.  

Gift Card Restrictions and Prohibited Activities. If you engage in the following activities, Company may prevent you from purchasing or redeeming Gift Cards or may take further action against your Account (this list is not exhaustive):  

i. Sell the Gift Card to a third-party or otherwise exchange the Gift Card for any cash, currency, or payment instrument;  

ii. Use a Gift Card as payment for any third-party goods or services;  

iii. Use a Gift Card to purchase any Company goods or services that are not eligible to be purchased via a Gift Card, to be decided by Company in our sole discretion;  

iv. Redeem a Gift Card where you are not the owner or intended recipient of the Gift Card;  

v. Transfer a Gift Card to another account following redemption;  

vi. Use a Gift Card for any illegal or unlawful purpose; or 

vii. Use a Gift Card to engage in any activity that is harmful to Company or otherwise disruptive to the Services or any other User.

Risk of Loss. THE RISK OF LOSS AND TITLE FOR PURCHASED GIFT CARDS ARE BORN ENTIRELY BY THE PURCHASER OR DESIGNATED RECIPIENT. YOU ARE RESPONSIBLE FOR SAFEGUARDING YOUR GIFT CARD FROM UNAUTHORIZED USE. COMPANY IS NOT RESPONSIBLE IF ANY GIFT CARD IS LOST, STOLEN, OR DESTROYED, OR USED WITHOUT YOUR PERMISSION. COMPANY ASSUMES NO LIABILITY TO YOU FOR, ANY UNLAWFUL CONDUCT OR FRAUD BY ANY THIRD PARTY ASSOCIATED WITH ANY GIFT CARD. 

COMPANY DOES NOT CONTROL COINBASE OR ITS OPERATIONS AND COMPANY DOES NOT CONTROL THE UNDERLYING SOFTWARE PROTOCOLS THAT GOVERN THE OPERATION OF THE RESPECTIVE CRYPTO CURRENCY NETWORKS, MOST OF WHICH ARE OPEN SOURCE. SUCH NETWORKS ARE SUBJECT TO SUDDEN CHANGES OR MODIFICATIONS IN OPERATING RULES THAT MAY MATERIALLY AFFECT THE VALUE, FUNCTION, OR NAME OF THE UNDERLYING CRYPTO CURRENCY. COMPANY WILL NOT BE RESPONSIBLE FOR A CHANGE IN ANY UNDERLYING CRYPTO CURRENCY NETWORK THAT RESULTS IN A FAILED PAYMENT OF SUCH CRYPTO CURRENCY. ADDITIONALLY, COMPANY SHALL NOT BE RESPONSIBLE FOR COINBASE DISCONTINUING ITS ACCEPTANCE OF ANY SPECIFIC TYPE OF CRYPTO CURRENCY FOR ANY REASON OR NO REASON.  

MALICIOUS ACTORS MAY ATTEMPT TO INTERFERE WITH CRYPTO CURRENCY NETWORKS IN A VARIETY OF WAYS INCLUDING, WITHOUT LIMITATION, MALWARE, DENIAL OF SERVICE, SPOOFING, OR SIMILAR ATTACKS. YOU SHOULD ALWAYS EXERCISE CAUTION WHEN MAKING PAYMENTS VIA CRYPTO CURRENCY. COMPANY IS NOT RESPONSIBLE FOR ANY ATTACK OR OTHER SECURITY INCIDENT THAT CAUSES YOUR CRYPTO CURRENCY PAYMENT TO FAIL OR OTHERWISE RESULTS IN A LOSS TO YOU.  

Laws with respect to Crypto Currency, both in the U.S. and around the world, are constantly changing. You are responsible for compliance with any applicable law with respect to your use of Crypto Currency.  

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY MAKES NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES,  EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURCHASE.
